The Individuals with Disabilities Education Act (IDEA) guarantees children with disabilities the right to a free appropriate public education (FAPE) in the least restrictive environment (LRE).
Not every child with a disability qualifies for an IEP. Section 504 of the Rehabilitation Act provides accommodations for students who need support but may not meet IDEA eligibility criteria.
Before pursuing a due process hearing, families and school districts may attempt to resolve disputes through mediation — a voluntary, confidential process facilitated by a neutral third party.
When mediation fails, families can request a due process hearing before an administrative law judge. This formal legal proceeding allows both sides to present evidence and testimony.
Families can file a complaint with the California Department of Education if they believe a school district has violated IDEA. The state must investigate and respond within 60 days.
